DFS License Details

Google Play Daily Fantasy Sports Terms and Conditions Agreement*

1. Your use of Google Play is subject at all times to your acceptance of and compliance with these additional terms and the Google Play Developer Distribution Agreement (“DDA”), currently located at https://play.google.com/about/developer-distribution-agreement.html, which is incorporated by reference (together, the "Google Play DFS Terms and Conditions"). A defined term used in these additional terms which is not defined here shall have the same meaning as set out in the DDA. "DFS Apps" means apps that offer or facilitate access to real money daily fantasy sports functionality that are submitted to Google Play and are governed by these Google Play DFS Terms and Conditions.  For the avoidance of doubt, these Google Play DFS Terms and Conditions are not applicable to any non-DFS Apps that may contain other games of skill, and any such apps shall continue to be permitted or not permitted on Google Play as set forth in the Google Play Developer Policies

2. You further warrant, represent, and undertake that:

   1. your app is a DFS App;

   2. you will only distribute your DFS App in US states and territories

   3. you currently hold a DFS License for your DFS App for any US state or territory that has laws or regulations that require providers of any real money daily fantasy sports functionality to hold a valid license prior to making any such functionality available to residents in such state or territory (a “DFS License”) and if you do not hold a DFS License for a given US state or territory that requires a DFS License, then you will restrict access to your DFS App so that users in any such state or territory cannot access any real money daily fantasy sports functionality in the DFS App;

   4. if, in the future, any US state or territory passes laws or regulations that require a DFS License for such US state or territory, then you will obtain such DFS license for your DFS App and, if you do not obtain and hold such DFS License as of the date that such requirement takes effect, then you will restrict access to your DFS App so that users in any such state or territory cannot access any real money daily fantasy sport functionality in the DFS App;

   5. your DFS Apps will comply with the terms of your DFS License, as well as all applicable laws, regulations, and relevant codes of practice;

   6. your DFS Apps are not aggregators of real money daily fantasy sports products or services owned or operated by third parties and do not otherwise contain functionality (other than ads that are in compliance with Google Play Developer Policies) that allow end users to access real money daily fantasy sports products or services owned or operated by third parties;

   7. you will comply with all applicable laws, regulations, and relevant codes of practice with respect to the content and function of your DFS Apps, which may include, but is not limited to:

      1. including your DFS License number within your DFS Apps;

      2. warning potential end-users that under-age use of your DFS App may be illegal;

      3. requiring that users affirm that they are of legal age to use the DFS App;

      4. implementing and maintaining required age-verification systems;

      5. ensuring that relevant staff are properly trained in the use of age-verification systems; and

      6. posting information about responsible gaming, making available self tests to allow individuals to determine whether they are at risk of addiction, providing information about treatment options for compulsive use, and indicating the location of treatment centers for addiction.

3. If you subcontract the development, management, uploading or distribution of your DFS Apps, in whole or in part, to any third parties, including, but not limited to, any affiliate entities or any of your associated companies, you are responsible for compliance by such third parties with the Google Play DFS Terms and Conditions and for any acts or omissions of the third parties pursuant to the Google Play DFS Terms and Conditions.

4. If any DFS License you hold (now or in the future) is terminated in any US state or territory, you must immediately inform Google and restrict access to your DFS App so users in any such state or territory cannot access any real money portion of the DFS App.

5. If any DFS License you previously submitted to Google is amended in any way, you must immediately inform Google and send an updated copy of the DFS License as soon as possible, together with an explanation of the changes.

6. You must inform Google immediately if you are the subject of any ruling by any legal or regulatory authority, or any industry body, which may be relevant to the DFS Apps and/or if you become aware that any age-gating or geo-gating functionality in your DFS App fails to function appropriately.

7. You agree to defend, indemnify and hold harmless Google, Authorized Carriers and Payment Processors, and any of Google’s, an Authorized Carrier’s or a Payment Processor’s affiliates, respective directors, officers, employees and agents, from and against any and all third party claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys fees) arising out of or accruing from any breach of the Google Play DFS Terms and Conditions by you or any third party.

8. No binding agreement is entered into until such time as Google notifies you that your application has been accepted. Google will send you a notification if and when your application has been accepted. Google reserves the right to remove any DFS App from Google Play at any time in accordance with its rights set out in the DDA, or if it otherwise decides to no longer permit DFS Apps on Google Play (in whole or in any particular country  or territory).
