Nest Renew Premium Additional Terms of Service

To use Nest Renew Premium, you must accept (1) the Google Terms of Service, (2) the Nest Terms of Service, (3) the Google Pay/Google Payments Additional Terms of Service (U.S.), and (4) these Nest Renew Premium Additional Terms of Service (the “Nest Renew Premium Additional Terms”). 

 

Please read each of these documents carefully. Together, these documents are known as the “Terms”. They establish what you can expect from us as you use our services, and what we expect from you. 

 

If these Nest Renew Premium Additional Terms conflict with the Google Terms of Service, the Nest Terms of Service, or the Google Pay/Google Payments Additional Terms of Service (U.S.), these Nest Renew Premium Additional Terms will govern for Nest Renew Premium. 

 

Besides these Terms, we also publish a Privacy Policy, which describes how we treat personal information when you use Google’s products and services. Although it’s not part of these Terms, we encourage you to read it to better understand how you can update, manage, export, and delete your information.

Nest Renew Doesn’t Provide Electricity

Nest Renew Premium is a paid service to help you support clean energy. Through Nest Renew Premium, Google may purchase renewable energy credits (RECs) on your behalf. We don’t generate, sell, or supply energy or electricity. Enrolling in Nest Renew Premium doesn’t change your electric utility provider. Enrolling in Nest Renew Premium also doesn’t affect the energy that your electric utility provider buys to power your home.

Utility Relationship and Billing

Utility Relationship. Google does not replace your utility or pay your utility bill. You remain responsible for paying your utility bill and monitoring and responding to communications from your utility provider. 
 

Disclaimer of Utility Liabilities. Google isn’t a party to any transaction between you and your electric utility provider. Your relationship with your electric utility provider is governed by the terms of that relationship and isn’t affected by these Terms or our provision of the Nest Renew Premium services. To the extent allowed by applicable law, Google isn’t liable for damages of any type (including direct and indirect damages) arising under or in connection with the supply, transmission, or distribution of electricity, including power outages or surges.

Clean Energy Match

Overview. We may purchase renewable energy credits (RECs) to match your home with enough clean energy to cover the fossil-fuel electricity use of the average US household. We refer to this as your “Clean Energy Match.” A “renewable energy credit” or “REC” is a certificate representing the environmental benefits from one megawatt hour of renewable electricity generation, and it is separate from the electricity itself. Clean Energy Match is a REC product and does not contain (or provide you with) electricity.
 

Details; Changes. You can find a detailed explanation of RECs and our methodology for providing your Clean Energy Match at g.co/nest/ecred. We reserve the right to make changes to this methodology at any time without notice to you. 

 

Estimates Not Guaranteed to Be Accurate. We try to accurately estimate the fossil fuel-generated electricity consumed by the average US household, but our estimates are only estimates. These estimates are based on the average US household and will vary from the actual amount of fossil fuel-generated electricity consumed at your home. 

 

REC Retirement. RECs serve as a tool for keeping track of which person (or entity) can take credit for the environmental benefits from renewable electricity generation. When a REC is “retired” on behalf of a person in a tracking system (like the North American Renewables Registry, for example), the environmental benefits represented by that REC are granted to that person permanently, so other people can’t take credit for them. You agree that we may retire RECs on your behalf, either by retiring RECs in your name or in Google’s name on your behalf. In either case, you – not Google – will have the right to take credit for the environmental benefits of RECs that are retired on your behalf.

Payments

Definitions.

Subscription Payment Service” means the service by which GPC stores your registered Payment Method information in connection with your Google Payments Account and facilitates processing of or processes a payment to Google LLC for the Nest Renew Premium services.
 

Subscription Payment Amount” means the dollar amount of a Subscription Payment Transaction for the Nest Renew Premium services to be paid to Google, and any related fees, taxes, or other charges, as applicable.

 

Subscription Payment Transaction” means the processing of a payment that results in the debiting or charging, or other related transaction, of the Subscription Payment Amount for the Nest Renew Premium services to your Payment Method.

 

Capitalized terms used but not defined in these Nest Renew Premium Additional Terms have the meaning stated in the Google Pay/Google Payments Additional Terms of Service (U.S.).

 

Billing for Nest Renew Premium.

 

Automatic Billing.

By enrolling in Nest Renew Premium, you agree to automatic payments for the amount you owe each billing period (as indicated on your statement). Unless otherwise stated when you enroll in Nest Renew Premium, your automatic payments will start on the date of your enrollment in Nest Renew Premium and will renew on each subsequent month anniversary of that day. You may cancel Nest Renew Premium or downgrade to Nest Renew Basic anytime prior to the next billing date, effective as of the next billing date. 
 

This is a recurring billing transaction. Unless otherwise stated, automatic payments and your Nest Renew Premium subscription will continue indefinitely until canceled by you or until automatically canceled by us as a result of your failure to keep necessary details up-to-date, like your Payment Method or street address, or for other reasons in our sole discretion. 

 

The Subscription Payment Amount will continue to be charged to your Payment Method or alternate Payment Method (if applicable) each billing period until you cancel the Nest Renew Premium services or downgrade to Nest Renew Basic, except as otherwise stated in these Nest Renew Premium Additional Terms. You may cancel recurring billing at any time by following the process described in the Nest Renew Cancellation Policy. Canceling recurring billing will cancel the Nest Renew Premium services. Cancellation will be effective immediately. Canceling the Nest Renew Premium services will immediately revoke your access to the Nest Renew Premium features. You can view details about pending or past transactions after canceling the Nest Renew Premium services for a limited period by visiting your Nest Renew account. 

 

In the event that your Payment Method fails and you don’t update your Payment Method information within 7 days of such failure, Google may automatically cancel your Nest Renew Premium services.

 

If you choose to delete your Google account, delete your Google Pay account, or delete (or leave) the Google Home structure associated with your Nest Renew Premium subscription, then effective immediately, (i) your Nest Renew Premium services and benefits will no longer be provided and (ii) Clean Energy Match may not be provided for the period of time between your most recent payment and date of cancellation.

 

We reserve the right to arrange for refunds or credits to the Payment Method debited or charged for the payment in question at our sole discretion. If we arrange for such a refund or credit, we are under no obligation to arrange for the same or similar refund in the future.

 

Free Trials

We may offer free trials of the Nest Renew Premium services for limited periods of time. If we offer you a free trial, the specific terms of your free trial will be provided at registration. We have no obligation to notify you when your free trial ends, and we reserve the right to modify or terminate free trials at any time, without notice and in our sole discretion.
 

Subscription Price Changes.

In the event we change the pricing for Nest Renew Premium following your enrollment, we will give you advance notice of this change. After receiving this notice, you will be deemed to have accepted the change in pricing, unless you cancel your subscription in accordance with the Nest Renew Cancellation Policy.
 

Refunds.

Except as expressly set out in these Additional Payment Terms and Conditions or required by law, Subscription Payment Transactions are nonrefundable. 
 

Customer Service Credits

We may issue you a customer service credit to be applied against amounts owed to Google for the Nest Renew Premium services. Such credits are issued by Google LLC, unless otherwise specified, and may only be redeemed against Subscription Payment Amounts. The credit will be automatically applied in its entirety to your next Subscription Payment Amount and will expire thereafter; any remaining balance may not be used for future Subscription Payment Amounts. These credits aren’t redeemable for cash or other cards or forms of payment, aren’t transferable, reloadable, or refundable, can’t be combined with other balances in your Google Pay account, and can’t be resold, exchanged, or transferred for value, except as required by law. We disclaim all express or implied warranties as to the credits and their redemption site.
 

Google is not responsible if a credit is lost, stolen, destroyed, or used without your permission. Google may close customer accounts and bill alternative forms of payment if fraudulently obtained credit is used. 

 

This section doesn’t apply to refunds or provisional credits, which are addressed separately above.

In addition to the payment dispute information above, please refer to Nest Renew Support to learn more about the support offered by Google in connection with Nest Renew. Nest Renew Support may be contacted at g.co/nest/contact or 1-855-870-2997.

Miscellaneous

Age Requirement. You must be eighteen (18) years or older to use Nest Renew Premium.


Changes to the Nest Renew Premium Additional Terms. We reserve the right to change, modify, or amend any portion of these Nest Renew Premium Additional Terms at any time, with or without notice to you. Changes to these Nest Renew Premium Additional Terms will become effective immediately unless stated otherwise. These Nest Renew Premium Additional Terms will be posted to the Nest Renew web portal. Your continued use of the Nest Renew Premium services will be deemed acceptance thereof. If we make any changes that we deem to be material, we will make a reasonable effort to inform you of such changes. If you don’t agree with changes to these Nest Renew Premium Additional Terms, your sole and exclusive remedy is to terminate your use of the Nest Renew Premium services.
