To use the Fitbit Service, you must accept (1) the Google Terms of Service, and (2) these Fitbit Additional Terms of Service (the “Additional Terms”). “Fitbit Service” includes Fitbit devices including associated firmware, applications, software, websites located at http://fitbit.com, APIs, and services.
Please read each of these documents carefully. Together, these documents are known as the “Terms”. They establish what you can expect from us as you use our services, and what we expect from you.
We also encourage you to read our Privacy Policy and these Fitbit FAQs on Privacy to better understand how you can update, manage, export, and delete your information.
Using the Fitbit Service
Our Service. We design products and tools that help you achieve your health and fitness goals and empower and inspire you to lead a healthier, more active life. After signing up for Fitbit using your Google Account, you will be granted access to the Fitbit Service.
Authorized Connections. You may only connect to the Fitbit Service using (1) a device that is manufactured, distributed, or sold by us or through our authorized resellers; (2) our mobile or wearOS applications and software, or approved third-party applications, third-party software, or third-party devices; or (3) our websites (“Authorized Connections”). You may not connect to the Fitbit Service with any device that is not manufactured, distributed, or sold by us or through our authorized resellers(such as a knock off or counterfeit version of a Fitbit device); otherwise intends to resemble or purports to be a Fitbit device; or any unauthorized application or third-party connection. If you have questions about whether a device or application qualifies as an Authorized Connection, please contact Customer Support.
Necessary Equipment. Use of the Fitbit Service is dependent upon your use of a supported mobile or wearOS device (a “Compatible Device”) and Internet access as set out here. The maintenance and security of your Compatible Device may influence the performance of the Fitbit Service and it is your responsibility to ensure your Compatible Device’s functionality. You are responsible for all Internet access charges. Please check with your Internet provider for information on possible Internet data usage charges.
Use of the Fitbit Service at Your Own Risk.
“Fitbit Content” includes any photos, images, graphics, video, audio, data, text, music, exercise regimens, food logs, recipes, comments, software, works of authorship of any kind, and other information, content, or other materials that are posted, generated, provided, or otherwise made available through the Fitbit Service. If you rely on any Fitbit Content or the Fitbit Service, you do so solely at your own risk.
Our goal is to provide helpful and accurate information on the Fitbit Service, but we make no endorsement, representation, or warranty of any kind about any Fitbit Content, information, or services unless expressly set out in these Terms.
We are not responsible for the accuracy, reliability, availability, effectiveness, or correct use of information you receive through the Fitbit Service. Maps, directions, and other GPS or navigation data, including data relating to your current location, may be unavailable, inaccurate, or incomplete.
Use of the Fitbit Service should not replace your good judgment and common sense. Please read and comply with all safety notices that accompany your use of the Fitbit Service, including those located on our Wear and Care page.
Statutory guarantees.
Applicable law in some jurisdictions may imply warranties, conditions, or guarantees or impose obligations which provide you with certain consumer rights. In some jurisdictions, such rights cannot be limited by a contract like these Terms. These Terms are in no way intended to restrict those rights.
Consult Your Doctor Before Using the Fitbit Service.
In General: The Fitbit Service is not intended to diagnose, treat, cure, or prevent any disease. If you have a medical or heart condition, consult your doctor before using the Fitbit Service, engaging in an exercise program, or changing your diet. If you experience a medical emergency, stop using the Fitbit Service and consult with a medical professional. Unless specifically listed here, please note that Fitbit’s devices, services, and algorithms have not been cleared by any health authorities for use in connection with any medical purpose.
Regulated Medical Device Software: The algorithms listed here are regulated medical device software that have been clinically validated and authorized for use in select countries and regions. Any reports from Fitbit’s regulated medical device software should only be used in accordance with the instructions for use accompanying that software. These features are not intended to be a substitute for consulting your healthcare provider and they do not provide a diagnosis of any medical condition. Instead, reports from these features are intended as information to seek advice from your healthcare provider who can then diagnose and treat any disease or medical condition you may have, taking into account your complete medical history. If you provide this information to your healthcare provider they may use this information, but only they can diagnose you with a disease or medical condition. It is your responsibility to present your medical data to your healthcare provider for further analysis and potential diagnosis. Do not disregard medical advice from your healthcare provider or delay seeking such advice based on the information obtained as a result of your use of these features.
Prolonged contact with wearable devices may contribute to skin irritation or allergies in some users. To reduce irritation, follow four simple wear and care tips: (1) keep it clean, (2) keep it dry, (3) don’t wear it too tight, and (4) give your wrist a rest by removing the band for an hour after extended wear. If you notice any skin irritation, soreness, tingling, numbness, burning, or stiffness in your hands or wrists while or after wearing the product, remove your device and please discontinue use. If any symptoms persist longer than 2-3 days after removing the device, consult your doctor.
Fitbit products using PurePulse technology have a heart rate tracking feature that may pose risks to users with certain health conditions. Consult your doctor prior to use of such products if you (1) have a medical or heart condition, (2) are taking any photosensitive medicine, (3) have epilepsy or are sensitive to flashing lights, (4) have reduced circulation or bruise easily, or (5) have tendonitis, carpal tunnel syndrome, or other musculoskeletal disorders.
Third Party Services.
The Fitbit Service may allow you to access, use or interact directly with third-party websites, apps, content, products and other services. Please note that when you use third-party services, their own terms and policies, in addition to the Terms, as applicable, will govern your use of those services.
Paid Services.
Note: If you are a Fitbit Premium member with a Fitbit Account, and not a Google account, then you are subject to the Fitbit Terms for Services and the Fitbit Terms for Paid Services.
Description: Fitbit Paid Services are subscription services such as Fitbit Premium and Fitbit Ace Pass that you may access in exchange for a fee (each a “Paid Service”). Some Paid Service features and content are not available in all countries or areas or in all languages. The terms in this “Paid Services” section apply to your use of the Paid Services.
Seller: When you purchase an Ace Pass through the Fitbit Ace App, the 'Fitbit Ace LTE and Ace Pass' section of these Terms applies to billing, payments, cancellations, refunds and similar issues for your Fitbit Ace LTE. When you purchase a different Paid Service, such as Fitbit Premium through an app store or the Google Store, you enter into a separate contract with the seller which applies to billing, payments, cancellation, refunds and similar issues for your Paid Service.
Deleting your Google Account: If you elect to delete your Google Account, you agree that you may lose access immediately to the Paid Service without refund for the remaining term. If you prefer to retain the Paid Services for the remainder of your billing period, please cancel your subscription following the steps here for Ace Pass or here for Fitbit Premium, rather than deleting your account.
Right of Withdrawal: If you’re an EEA- or UK-based consumer, you have the right to cancel within 14 days of signing up for or upgrading your Paid Service membership without giving any reason. If you’re a South Korea-based consumer, you may exercise your right to cancel within 7 days of signing up for, upgrading, or renewing your Paid Service, unless you have already used the service. To exercise the right of withdrawal, you must communicate your decision to withdraw by an unequivocal statement to the provider from which you made the purchase.
Fluctuations and Interruptions: For Paid Services that include wireless connectivity services, our coverage maps only approximate our anticipated wireless coverage area outdoors under optimal conditions. The actual service area, coverage, speed, and quality of service may fluctuate based on numerous factors such as signal strength, network congestion or capacity limits, hardware limitations, the weather, and any other factors that are beyond our control. Outages and interruptions in the availability of the Paid Services may occur, and use of features, may be interrupted or fail.
Paid Service features that rely on location information may depend on network coverage and may depend on your device's ability to acquire satellite signals (typically not available indoors) or cell antenna sites. For that reason, the availability or your use of these features may be interrupted. As we improve features, coverage maps may change over time.
Acceptable Use: You may use the Safety Signal feature and access Ace Pass only as permitted and in a manner that complies with these Terms and all materials made available to you when you receive access to the Paid Services. If your usage is excessive, or abnormally high, we may limit, suspend, or stop providing the Safety Signal feature or the Ace Pass subscription without notice to you.
Safety Signal: If you have an applicable Google Pixel Watch LTE device and have not enabled a 4G LTE watch line, your Fitbit Premium subscription may provide you with access to certain wireless features, such as Emergency Sharing, Fall Detection, and Safety Check, and you may be able to reach emergency services and contacts (the “Safety Features”) even when you don’t have your phone nearby (“Safety Signal”). Safety Signal is not intended to be used as a general purpose wireless communications service. These Safety Features are not intended to be solely relied on in situations where more immediate or effective help is available and may be obtained. Fitbit Ace LTE and Ace Pass.
Ace Pass service: An Ace Pass is a Paid Service used with a Fitbit Ace LTE device.
The Ace Pass is provided by the service provider listed here. When you purchase an Ace Pass, you enter into a contract with that service provider as the seller.
Billing and Payment: Ace Pass subscriptions automatically renew. You will be automatically charged each billing period until you cancel. We may use affiliates to process payments. Payments you make for the Ace Pass will be taken by the payment entity listed here. To purchase an Ace Pass, you must have a Google Payments account and agree to the Google Payments Terms of Service.
Cancellation and Refunds: You can cancel your Ace Pass as described in the Ace Pass Cancellation and Refund policy. If you cancel your Ace Pass, you will retain access to the Ace Pass service for the remainder of your current billing period, unless you have other cancellation or withdrawal rights as described in the Ace Pass Cancellation and Refund policy.
Changes to Pricing: You’ll be charged the Ace Pass price listed at the time of purchase. If the price later increases, we’ll notify you in advance by email. If you’re given at least 30 days’ notice, the increase will apply to the next payment due from you after the notice. If you’re given less than 30 days’ notice, the price increase will not apply until the following renewal. If you do not wish to pay the increased price for a subscription, you may cancel before the increase takes effect by following the instructions in the Ace Pass Cancellation and Refund policy.
